Official Rules and Disclosures
1. You must be 18 years or older to purchase a raffle ticket. Only one (1) individual may be identified as the purchaser of the raffle ticket. All federal, state and local laws and regulations apply.
2. Each ticket will cost $50. There is no limit on the number of tickets that any particular individual or entity may purchase.
3. This is a raffle and tickets may be purchased via the website (www.church-alive.org) or in person. Each purchased ticket will be assigned a unique number that will represent their raffle ticket number. This number will be used in the drawing. In all questions of ticket number assignation, Church Alive's decision shall be final. Ticket number(s) and purchase confirmation will be e-mailed to the purchaser upon completion of the purchase.
4. All e-mail communications will be sent to the e-mail address supplied during the purchase. It is the purchaser's responsibility to provide a valid, deliverable mailing address and e-mail address to 2001corvetteraffle@comcast.net. Church Alive is not responsible if the purchaser's ISP or computer protection blocks or otherwise restricts the confirmation e-mail from being delivered (i.e., spam filters, etc.). All e-mail regarding the Church Alive charity raffle will be sent to or from the e-mail address 2001corvetteraffle@comcast.net.
5. By entering the raffle, the ticket purchaser acknowledges that he or she is aware of and agrees with the raffle's official rules as follows:
6. A maximum of 5000 tickets are available for purchase for the "Church Alive Raffle." A minimum of 1500 tickets must be sold by the deadline date for drawing to take place. In the event that less than 1500 tickets are sold, Church Alive will be responsible to inform all ticket holders by email (or phone, if no email address was given) that the minimum amount of ticket sales was not met. Every ticket holder will be eligible for a refund of the ticket price. The option to donate the amount to Church Alive will be offered. If the option to donate is utilized, it must be conveyed in writing at which time a tax-deductible receipt will be issued. Ticket sales will begin on Dec 1, 2007. DEADLINE ADVANCED TO SEPTEMBER 30, 2008. To reach the minimum number, Church Alive has extended the deadline. Current ticket holders may remain in the drawing or elect to utilize an option as stated above.
7. The winner will be notified by phone and by e-mail to the e-mail address supplied during the purchase of the raffle ticket (provided an e-mail address was given, in which case, a letter will be sent). The winner will have fifteen (15) days from the notification of winning, to confirm his/her address and his/her acceptance of the prize won. If a selected winner is unable to be contacted or located after a period of ninety (90) days from the drawing date of the raffle, or if the selected winner declines acceptance of the prize, the prize or its cash equivalent will be deemed to have been donated to Church Alive to be used to support the Church Alive non-profit mission statement.
8. Winners' names and locations by state, will be posted on the Church Alive website (www.church-alive.org) as proof of actual drawing and winner. Entrants, by purchasing ticket(s), consent to the use by Church Alive of their name and location by state on the website and in other promotional materials.
9. Church Alive and its officers, employees, agents, board, and vendors assume no liability for late, misdirected, incomplete, undelivered entries or entries without proper payment received, which entries shall be deemed invalid and shall be immediately disqualified. Church Alive Board Members are not eligible to participate in this raffle.
10. All purchases of raffle tickets are final and non-refundable unless the minimum tickets are not sold.
11. Prize: one Prize is all that will be awarded. Prize is as is and seen. The approximate retail value the prize is $26,000.00 . No cash or cash value of said 2001 Corvette will be substituted. The 2001 Corvette must be accepted unless winner declines taking possession of the 2001 Corvette or decides to donate it back to Church Alive, Inc. If winner decides to decline or donate Corvette back to Church Alive, this decision must be submitted in writing and Church Alive, Inc. will be released from any obligation to the winner and will use the proceeds in its mission.
The odds of winning a prize are dependent upon the number of valid entries received. In the event a winning entry has more than one name, Church Alive, Inc. will award the prize to the first name listed on the entry. Church Alive shall be deemed correct; if there is any discrepancy, Church Alive is not responsible for resolving any disputes that may arise from different individuals listed on a raffle ticket. Each prizewinner is solely responsible for paying all applicable federal, state and local taxes associated with their respective prize, also for title, registration, insurance.
12. Church Alive will deliver the 2001 Corvette to any of the lower 48 states in the continent U.S. within 30 days of acceptance of prize, unless the winner chooses to take possession in person at Portsmouth, NH. At which time, the clear title will be given with the vehicle. Again, there is no warranty implied, stated or given; the vehicle is "as is and seen” condition. If the winner is from outside the 48 lower states of the United States (USA), the winner will have 30 days to pick up vehicle and is responsible and libel for all or any shipping cost incurred to get to winner’s location. After 30 days of acceptance of prize, if not picked up, the prize will be forfeited and donated back to Church Alive. Winners will be informed of said action by email.
13. The IRS has taken the position that amounts paid for chances to participate in raffles, lotteries or similar programs are not gifts and, therefore, the price of a Church Alive ticket purchase does not qualify as a deductible charitable contribution.
14. All monetary figures described in these rules and regulations are listed in United States Dollars (USD). All purchasers, by participating (and winners, by accepting the prize) release Church Alive and its respective Board, officers, committee members, employees, volunteers, partners, vendors, agents, representatives, sponsors, service agencies and independent contractors, and each of their respective directors, officers, partners, employees and agents, including advertising, public relations, direct marketing and promotion agencies, from any and all liability with respect to participation in the raffle and possession or use of the prize awarded and also acknowledge that they did not receive any representations, warranty or guarantee, express or implied, in fact or in law, relative to the prize, including but not limited to its quality, mechanical condition or fitness for a particular purpose. Any liability of Church Alive shall be limited to the ticket price paid and in the case of any disputes Church Alive’s decision shall be final. Church Alive reserves the right to modify or amend these Rules without notice at any time, so please read this page regularly to ensure you are updated as to any changes.
